Introduction
Welcome to the yovo's terms of service.
 
Our terms of service describe what yovo does for you and the charities and other causes you support, and what we require of you as a user.
 
“Cause” and “cause” refers to charities and other causes you support through use of our service.
 
“yovo” or “us” or “we” refer to the owner of the app, You Volunteer Ltd.
 
“App” refers to https://app.yovo.org.uk
 
“You” and “your” refers to each user or viewer of the App, including volunteers, volunteer coordinators, and charities.

  • User Conduct — If you volunteer for a charity or use any of our services, please remember yovo is for everyone. If we find offensive, defamatory, libelous, threatening, harassing, or obscene content on the App, we will remove it and terminate your access. Please ensure the content you upload to the site, especially pictures, does not infringe another person’s copyright.

Terms of Service

These terms of service govern your use of the App. Please read these Terms carefully. Your use of the App your assent to these Terms.

 

We may update these Terms from time to time. It is your responsibility to review these Terms wherever you access the App. The latest version of these Terms will govern any future usage by you of the App and its associated services. The date on which these Terms were last updated is stated at the end of this document.

 

About the Causes featured on the App:

The App allows you to volunteer for all Causes with ‘Past’ or ‘Upcoming’ event listings.  Each of these Causes has an agreement with Yovo authorising Yovo and/or You Volunteer (defined below), allowing them to access the information they need to coordinate their signed-up volunteers and events. Causes are listed on this App at Yovo's discretion; however, we are not responsible for the activities of any Cause. A charity must have the appropriate authorisation, permit or licence to operate as a charity, as required by the local laws of the territory in which it operates.

 

Your Conduct

Whilst Yovo takes reasonable steps to check sessions that are submitted to us, we cannot check in detail all sessions and shall not be responsible for any loss or harm that may occur to you in performing any session.

You must at all times use the App in a responsible and legal manner and ensure that the content you provide does not breach any intellectual property rights of a third party or breach any right or duty owed to a third party.

You are under no obligation to undertake any session offered to you by Yovo or the Cause. 

You undertake each session of your own free will and are responsible for ensuring that the session is carried out safely and that you do not put yourself or your colleagues at risk. In particular, you are not permitted to carry out any session without first notifying Yovo. You must ensure that Yovo are aware of the time and location of every session you undertake. You must ensure that a risk assessment form has been completed and provided to you prior to you accepting or commencing any session. You must comply with any instructions in the risk assessment form.

You are advised to always carry a mobile phone on your person whilst commencing a session. If you have any doubts or concerns at any time prior to, during or after a session, you must immediately contact the respective Cause representative, or in an emergency call 999. If you are hurt or injured or feel unwell during the performance of a session, you must immediately notify any respective Cause representative or volunteer with you, or call the respective Cause representative. In an emergency you must call 999.

You acknowledge and agree that working with vulnerable people is a regulated activity in the UK. You understand that if we become aware of any breach of any of the undertakings or of any warranty set out in 1.A becoming untrue, or if we reasonably believe that any such undertaking may have been breached or that any warranty may have become or be about to become untrue, we shall be permitted to remove your account and access, and notify any law enforcement agency without informing you of such notification.

1.A Prior to commencing any Yovo session or activity, you undertake and agree to:

  1. provide to Yovo all necessary information to enable Yovo to apply for a current, original and valid enhanced CRB check showing that you have no criminal record;

  2. only perform sessions with vulnerable persons where such session has been offered to you by Yovo;

  3. immediately inform Yovo of the occurrence of any matter set out in paragraph 1.A above;

  4. not take any money or other non-pecuniary form of remuneration from any person to whom any Yovo session or activity, other than in the case in which repayment for a delivery is explicitly defined in the description of the session on the App or instructions from Causes staff;

  5. keep Yovo informed of your contact with any person to whom you have been introduced by Yovo;

  6. never introduce any person to a person to whom you have been introduced by Yovo without the prior written consent of Yovo; and

  7. in performing any session or activity always comply with Health and Safety requirements and any specific instructions or recommendations of Yovo or the Cause.

You represent and warrant that:

  1. you have never been convicted in any jurisdiction of any offence of violence, sexual impropriety, or any offence against a child or other vulnerable person; and

  2. you are not currently under investigation in respect of any matter falling within the offences detailed in (a) and you are not aware of any circumstances that could result in you being investigated, cautioned or arrested in respect of any such matter.

You agree not to interfere with the servers or networks connected to the App or to violate any of the procedures, policies or regulations of networks connected to the App, including these Terms of Service. You also agree not to:

  1. attempt to reverse engineer or sell, export, license, modify, copy, distribute or transmit the App to any third party, or jeopardize the correct functioning of the App, or otherwise attempt to derive the source code of the software (including the tools, methods, processes and infrastructure) that enables or underlies the App;

  2. attempt to gain access to secured portions of the App to which you do not possess access rights;

  3. impersonate any other person while using the App or taking part in any Yovo activity and/or performing any Yovo session;

  4. conduct yourself in a vulgar, offensive, harassing or objectionable manner while using the App;

  5. resell or export the software associated with the App;

  6. use the App to generate unsolicited advertisements or spam; or

  7. use any automatic or manual process to search or harvest information from the App, or to interfere in any way with the proper functioning of the App.

No warranty and liability limit

Yovo provides the App "as is" and without any warranty or condition, whether express, implied or statutory. Yovo specifically disclaims any implied warranties of title or merchantability for a particular purpose and non-infringement. Yovo assumes no liability or responsibility for any errors or omissions in the App; any losses or damages arising from the use of the App or from taking part in any Yovo sessions; any harm to your reputation or losses resulting from any disclosure of information about you by us as permitted in these Terms of Service. We reserve the right to deliver the App and our services in our sole and absolute discretion.

In no event shall Yovo or its Founder, be liable to you for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the App, you taking part in any App session, or these Terms of Service, on any theory of liability, and whether or not advised of the possibility of damage.

Yovo does not seek to exclude liability for death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

By permitting you to access the App or perform any sessions or take part in activities we are not representing or warranting that you are suitable to, or permitted by law to, volunteer to perform such sessions or work with vulnerable persons. It is solely your responsibility to ensure that you are compliant with applicable law.


General

You agree that these Terms of Service and any claim, dispute or controversy arising out of in connection with these Terms of Service or their subject matter or formation (including non-contractual disputes or claims), or the App shall be governed by and construed in accordance with English law. Any dispute or claim arising out of or in connection with such matters (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of England and Wales. 

Yovo may change or discontinue the provision of the App and/or its services at any time without prior notice. We reserve the right to terminate these Terms of Service for any reason, without notice, and these Terms of Service shall automatically terminate in the event that you violate any of the terms of Service set forth herein (without prejudice to our accumulated rights against you). In the event of any termination, you will immediately cease use of the App and will cease to contact any person with whom you have been introduced by Yovo.

These Terms of Service are agreed between you and us. No person shall have any rights under or connection with these Terms of Service under the Contracts (Rights of Third Parties) Act 1999.

If any court or competent authority decides that any term of these Terms of Service is held to be invalid, unlawful or unenforceable to any extent, such term shall, to that extent only, be severed from the remaining terms, which shall continue to be valid to the fullest extent permitted by law.

Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section.

Our failure to enforce any provision of these Terms of Service shall not constitute a waiver of that or any other provision and will not relieve you from the obligation to comply with such provision.

These Terms of Service set forth the entire understanding and agreement between you and Yovo with respect to the subject matter hereof.

Charity Conduct 

  1. Suspension of Account: 1.1 In the event that the Charity is found to engage in misconduct or is subject to an ongoing police investigation, the Service Provider reserves the right to suspend the Charity's account and temporarily restrict access to its services, subject to the provisions of this Agreement.

  2. Misconduct and Investigations: 2.1 Misconduct, as referred to in this Agreement, shall include, but not be limited to, any act or omission that violates applicable laws, regulations, ethical standards, or any conduct that brings disrepute to the Charity or the Service Provider. 2.2 Police investigation, as referred to in this Agreement, pertains to any official investigation initiated by law enforcement agencies in relation to the Charity's activities, potential criminal offenses, or any legal matters requiring police intervention.

  3. Notice of Suspension: 3.1 If the Service Provider becomes aware of any misconduct or police investigation involving the Charity, it shall promptly notify the Charity in writing of the suspension of its account. 3.2 The notice shall include the reasons for the suspension, the effective date of suspension, and any additional steps or information required from the Charity to resolve the situation.

  4. Account Reinstatement: 4.1 Following the suspension of the Charity's account, the Service Provider shall undertake a thorough review of the circumstances surrounding the misconduct or police investigation. 4.2 Based on the findings of the review, the Service Provider may, at its sole discretion, reinstate the Charity's account upon satisfying itself that the concerns have been adequately addressed, and there is no ongoing risk or legal liability associated with the Charity's activities.

  5. Termination of Agreement: 5.1 Notwithstanding the provisions of account suspension, the Service Provider reserves the right to terminate this Agreement if the Charity's misconduct or police investigation presents significant legal or reputational risks to the Service Provider, or if the concerns persist despite reasonable efforts to rectify the situation.

  6. Liability: 6.1 The Service Provider shall not be liable to the Charity or any third parties for any damages, losses, or costs incurred as a result of the suspension of the Charity's account or termination of this Agreement under this clause.
